Copyright Question New Item

Post by tnbndr »

Fresh off the table.
Not using any logos etc. Is there anything in this design that would be considered copyrighted? Asking before I offer these for sale.
My opinion is NO but some of you have more experience.

Those are both City names. How could they claim copyright? I use Auburn (the city of) I don't use Auburn University.

That Looks fine, But along with Copyrights, which may have more to do with shapes of items and such, a Trade Mark (TM) on the other hand no matter what font cannot be used.

I wouldn't worry about it but a trademark or copyright is more than using Images, names, etc. I've patented several things and have learned a lot about the whole TM/CR issues. The issue, if it would ever go to court, will be the "Intent" of someone producing such designs. Your project is clearly a ticket stub for the Green Bay - Dallas game. Your intent is to make a profit off of The NFL owned names of Green Bay and Dallas Football teams. Using each name separate is no problem. BUT the way you have it designed the NFL could clearly show your trying to profit off their TM/CR names and force you to stop making them. NFL has won numerous court cases where ppl made things with just the name of a team and colored it in teams colors. Just those two basic distinctions were enough to show the intent to profit off the NFL names. Yes the NFL and other big TM/CR owners can strong arm because they have the attorneys and funds to do so.

NOW........I wouldn't worry about it and still make them. Unless you start selling 1k's of them and it becomes a internet sensation and draws attention to NFL.
